1. Agreement to Terms

By accessing or using the services provided by CryptoAppraisal Pro ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

2. Description of Services

CryptoAppraisal Pro provides independent appraisal services for cryptocurrency assets donated to charitable organizations. Our services include:

  • Fair market value determination of cryptocurrency donations at the time of gift
  • Preparation of qualified appraisal reports designed to meet IRS requirements
  • Supporting documentation for IRS Form 8283

Important: Our services are strictly appraisal services. We do not provide tax advice, legal advice, financial advice, or investment advice. You should consult with qualified professionals regarding your specific situation.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete information
  • Not use our services for any unlawful purpose or in violation of any applicable laws

4. Orders and Payment

4.1 Ordering

When you place an order, you agree to provide accurate and complete information about yourself and the donation you wish to have appraised. We reserve the right to refuse service to anyone for any reason.

4.2 Pricing

Prices for our services are as listed on our website at the time of order. All prices are in U.S. dollars. We reserve the right to change prices at any time, but changes will not affect orders already placed.

4.3 Payment

Payment is due at the time of order and is processed securely through our payment processor. By providing payment information, you represent that you are authorized to use the payment method provided.

5. Refund Policy

Before Work Begins: If you cancel your order before we have begun work on your appraisal, you are entitled to a full refund.

After Work Begins: If you cancel after we have begun work, you may be eligible for a partial refund based on the work completed. Refund amounts will be determined on a case-by-case basis.

After Delivery: Once your appraisal report has been delivered, no refunds are available. However, we offer revisions to address any concerns with the report (see Section 6).

6. Revisions

Each service tier includes a specified number of revisions:

  • Standard: One revision within 7 days of delivery
  • Rush: Two revisions within 7 days of delivery
  • Complex: Unlimited revisions within 14 days of delivery

Revisions are limited to corrections based on information you provided or clarifications of our analysis. Material changes to the donation details or new information not originally provided may require a new order.

7. Delivery

We will deliver your appraisal report within the timeframe specified for your selected service tier, barring unforeseen circumstances. If we require additional information from you, delivery times may be extended. We will notify you promptly of any delays.

8. Your Responsibilities

You are responsible for:

  • Providing accurate, complete, and truthful information about your donation
  • Retaining copies of all documentation related to your donation
  • Consulting with qualified tax and legal professionals regarding your specific situation
  • Properly filing your tax returns in accordance with applicable laws
  • Responding promptly to any requests for additional information

9. Limitations of Service

You understand and agree that:

  • Our appraisals are based on the information you provide and publicly available market data
  • We do not guarantee the IRS or any other authority will accept our appraisal
  • We are not responsible for how you use our appraisal or the tax consequences of your donation
  • Our appraisals are not audits, reviews, or compilations of financial information
  • We do not verify the legitimacy of the charity or the validity of your donation

10. Intellectual Property

All content on our website and in our reports, including text, graphics, logos, and software, is the property of CryptoAppraisal Pro or its licensors and is protected by intellectual property laws. You may use your appraisal report for its intended purpose (supporting your tax filing) but may not reproduce, distribute, or modify our content without our written permission.

11. Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOAPPRAISAL PRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE OUR SERVICES
  • ANY ERRORS OR OMISSIONS IN OUR APPRAISALS
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS
  • ANY THIRD-PARTY ACTIONS, INCLUDING TAX AUTHORITY DETERMINATIONS

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless CryptoAppraisal Pro and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of another.

14. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state of our principal place of business, and the arbitrator's decision shall be final and binding.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services after any modifications constitutes acceptance of the modified Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state of our principal place of business, without regard to conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
